Notice of Application to Stop Up Highway between Bridport and Bradpole, Dorset

At 3:20pm on the 25 January 2022 the Council as Highway Authority for the County of Dorset intends to apply to the Dorset Magistrates' Court sitting at Weymouth Magistrates' Court, the Law Courts, Westway Road, Weymouth Dorset DT4 BBS for an application under Section 116 of the Highways Act 1980. The effect of this Order, if made, will be to stop up public highway rights over a section of highway between Bridport and Bradpole, Dorset. A plan illustrating the extent of the Order applied for may be inspected free of charge at County Hall, Colliton Park, Dorchester DT1 1XJ during its normal opening hours. Anyone aggrieved by this application may oppose it by attending in person at the Weymouth Magistrates' Court on 25 January 2022 at 3:20pm and they will have the right to be heard. Notice of Confirmation of a Public Path Diversion and

Definitive Map and Statement Modification Order Highways Act 1980 Wildlife and Countryside Act 1981 Dorset Council (Part of Bridleway 39, Symondsbury at Lower Eype Farm) Public Path Diversion Order 2021

On 19 November 2021 Dorset Council confirmed the above-named order made under Section 119 of the Highways Act 1980 as unopposed and the Council has certified that work has been carried out to bring the site of the new highway mentioned in article 3 of the order into a fit condition for use by the public. The effect of the order as confirmed is to divert part of Bridleway 39, Symondsbury at Lower Eype Farm as shown on the order map as follows: From the existing way:

The full width of the bridleway from the unaffected part of Bridleway 39, Symondsbury, south west of Lower Eype Farm at SY 44689171, generally east along a grass surfaced track to SY 44739171 and continuing east across a concrete yard to rejoin the unaffected part of Bridleway 39, Symondsbury, north north east of Dairy Cottage at SY 44789171. To the new way:

From the unaffected part of Bridleway 39, Symondsbury, south west of Lower Eype Farm at SY 44689171, generally east north east along a grass surfaced track to SY 44699172 then north east along the track to its junction with the current route of Footpath 43, Symondsbury at SY 44729175. Continue north east (following the current route of Footpath 43 (part to be upgraded to Bridleway)), then turning south east to SY 44749175 and then generally south east along a concrete surfaced track to rejoin the unaffected part of Bridleway 39, Symondsbury, north north east of Dairy Cottage at SY 44789171. The width varies: 3.4 metres between SY 44689171 and SY 44749175, narrowing to 3 metres between SY 44749175 and SY 44789171. The order comes into force on 26 November 2021 but if any person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within six weeks from 16 December 2021, make an application to the High Court. Re: "stop up public highway rights over a section of highway between Bridport and Bradpole, Dorset" - is this for real? Hundreds of residents use this path (walking and cycling) to access shops and Bridport EVERY DAY. It's on Dorset Council's own cycle map and signed (Route 267) - what's the point in spending all that money on the path alongside Sea Road North only to close this important section linking Bradpole? If closed off it would completely cut off pedestrian and cycle access to the river path and access to a section of the Asker from the Northern end of the trail. Handy that the Magistrate court at Weymouth has been selected for this - not! This nonsense has to be nipped in the bud.
