NO ONE will face charges in relation to the death of a man who died after his boat fell on him at a Weymouth harbourside yard.

Kevin Keeler, 56, was carrying out repairs beneath the 29ft yacht at Weymouth Sailing Club on April 16 when it suddenly toppled over on to him.

Despite attempts to save him, Mr Keeler was pronounced dead at the scene.

Dorset Police, the Health and Safety Executive (HSE) and Weymouth and Portland Borough Council (WPBC) launched investigations into the incident.

A spokesman for Dorset Police said: "Police investigated the death of Mr Keeler, however having established no criminal offences, the matter was referred to WPBC to determine whether there were any breaches of health and safety legislation."

However, WPBC have now confirmed their investigations have concluded.

Cllr Mike Byatt, spokesman for community safety WPBC, said: “Our sympathies go out to the family and friends [of Mr Keeler].

"It was found that the activity leading to the death of Mr Keeler was not considered as a work activity of the sailing club.

"There was therefore no remit for further investigation by the council under the Health and Safety at Work Act."

A spokesman for HSE said the executive was notified by police of an incident at Barrack Road, Weymouth, on April 16.

The spokesman said during initial enquiries it was established the local authority enforces health and safety regulations at this site and therefore any investigation was to be carried out by WPBC with on-going support from HSE if requested.

Mr Keeler had been a keen sailor since he was a teenager and had bought the boat together with his partner in January.

At the time of the incident, Mr Keeler had taken the boat out of the harbour to carry out two weeks of maintenance to it.
